AN ACT to amend the public health law, in relation to establishing a
Legionnaires' disease awareness and education program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 267-c to read as follows:
3 § 267-c. Legionnaires' disease awareness and education program. 1. The
4 department shall conduct an ongoing public awareness and education
5 program under section two hundred seven of this article on the symptoms,
6 diagnosis and treatment of Legionnaires' disease.
7 2. The department shall produce and distribute educational materials
8 on the risks of Legionnaires' disease, symptoms of Legionnaires' disease
9 and available treatments. Such materials shall be made available to
10 appropriate health care providers for distribution to patients. The
11 department shall also provide information on the symptoms, diagnosis and
12 treatment of Legionnaires' disease on the department's internet website.
13 No provision of this subdivision shall be deemed to prohibit the utili-
14 zation and distribution of educational materials relating thereto
15 produced by any public, private or governmental entity, in lieu of the
16 department's production of such materials.
17 3. The department shall periodically review available data on the
18 symptoms, diagnosis and treatment of Legionnaires' disease and update
19 the information provided in its educational materials and on its inter-
20 net website, as appropriate.
21 4. The department shall report every three years, commencing January
22 first, two thousand twenty-eight, to the governor, the temporary presi-
23 dent of the senate and the speaker of the assembly on the implementation
24 of this section and any recommendations for furthering the purpose of
25 this section.

1 5. Implementation of this section shall be contingent upon and shall
2 be conducted within appropriations made therefor.
3 § 2. This act shall take effect on the one hundred eightieth day after
4 it shall have become a law. Effective immediately, the addition, amend-
5 ment and/or repeal of any rule or regulation necessary for the implemen-
6 tation of this act on its effective date are authorized to be made and
7 completed on or before such effective date.
