        AN ACT to amend the legislative law, in  relation  to  requiring  fiscal
          notes  for  bills imposing mandated benefits under insurance plans and
          under the Medicaid fee-for-service program

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The legislative law is amended by adding a new section 50-a
     2  to read as follows:
     3    § 50-a. Fiscal note in insurance mandate bills. 1. A bill which enacts
     4  or  amends  any  provision  of law that imposes a new mandated insurance
     5  benefit or service, or that expands an existing mandated insurance bene-
     6  fit or service, shall contain an actuarial fiscal note stating the esti-
     7  mated annual cost to the insurance premium on policyholders affected  by
     8  such enactment or amendment and the source of such actuarial estimate.
     9    2.  This  section  shall apply to all bills that will impact insurance
    10  plans of the state of New York or of any of its  political  subdivisions
    11  and  also to all bills that will impact any insurance plan offered by an
    12  insurer doing business in this state as an authorized insurer.  For  the
    13  purposes  of  this  subdivision,  "doing  business  in  this state as an
    14  authorized insurer" shall have the same meaning as "doing  an  insurance
    15  business" as defined in section eleven hundred one of the insurance law.
    16    3.  The  fiscal note shall contain an actuarial analysis of the poten-
    17  tial insurance premium impact of imposing such  new  mandated  insurance
    18  benefit or service or expanding such existing mandated insurance benefit
    19  or  service,  as  well  as  an  analysis  of its potential impact on all
    20  segments of the insurance market.
    21    4. An omission of such fiscal note shall invalidate such bill.
    22    § 2. The legislative law is amended by adding a new  section  50-b  to
    23  read as follows:

     1    §  50-b. Fiscal notes for Medicaid fee-for-service benefit expansions.
     2  1. Any bill which amends the social services law or any other  provision
     3  of law in a manner that adds, expands, or requires coverage of any bene-
     4  fit  or service under the Medicaid fee-for-service program shall contain
     5  a  fiscal  note  stating  the  estimated annual cost to the state and to
     6  local social services districts resulting from such amendment.
     7    2. The fiscal note required by  this  section  shall  be  prepared  in
     8  consultation with the department of health and the division of the budg-
     9  et.
    10    3. An omission of such fiscal note shall invalidate such bill.
    11    § 3. This act shall take effect immediately.
