        Introduced  by  Sen. SALAZAR -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the social services law,  in  relation  to  guaranteeing
          access to certain public benefits for non-citizens
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 398-e of the social services  law,  as  amended  by
     2  chapter 669 of the laws of 2022, is amended to read as follows:
     3    §  398-e.  Eligibility  for protective services, foster care services,
     4  [and] residential services for victims of domestic  violence  and  other
     5  public  benefits  and  services. A noncitizen, including a non-qualified
     6  alien, as determined by applicable federal statute  and  regulation,  is
     7  eligible  for  protective  services for adults and children, foster care
     8  services, [and] prevention services, adoption subsidy, kinship guardian-
     9  ship assistance, after-care services for  youth  and  families  involved
    10  with  child  welfare,  child  care  assistance, residential services for
    11  victims of domestic violence, and all other public services and benefits
    12  to the extent such person is otherwise eligible pursuant to this chapter
    13  and the regulations of the office of children and  family  services  and
    14  the office of temporary and disability assistance.
    15    § 2. This act shall take effect immediately.
