AN ACT to amend the education law, in relation to establishing a trans-
fer student appeal process
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 320 to
2 read as follows:
3 § 320. Transfer student appeal process. 1. The commissioner, in
4 consultation with the office of standards and instruction within the
5 department, shall establish a transfer student appeal process that oper-
6 ates solely at the state level.
7 2. The appeal process established pursuant to this section shall
8 provide students with an option to pursue a second opinion regarding the
9 status of their transfer credits from out-of-state schools, out-of-coun-
10 try schools, or non-public schools.
11 3. A student may only use the appeal process after they have already
12 completed the transfer credit process at the school district they
13 enrolled into.
14 4. Decisions made through the appeals process established pursuant to
15 this section shall be considered final.
16 5. The commissioner shall promulgate any rules and regulations neces-
17 sary for the implementation of this section.
18 § 2. This act shall take effect on the ninetieth day after it shall
19 have become a law. Effective immediately, the addition, amendment and/or
20 repeal of any rule or regulation necessary for the implementation of
21 this act on its effective date are authorized to be made and completed
22 on or before such effective date.
