        Introduced  by Sen. BORRELLO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
 
        AN ACT to amend the vehicle and traffic law, in relation to  authorizing
          law  enforcement to seize class three bicycles with an electric assist
          when such bicycles are found outside a city having a population of one
          million or more

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivisions 10 and 12 of section 1242 of the vehicle and
     2  traffic law, as added by section 8 of part XX of chapter 58 of the  laws
     3  of  2020,  are  amended  and  a  new  subdivision 14 is added to read as
     4  follows:
     5    10. The operation of  a  class  three  bicycle  with  electric  assist
     6  outside  of a city having a population of one million or more is prohib-
     7  ited. Any peace officer as such term is defined in section 2.10  of  the
     8  criminal  procedure law shall be authorized to seize a class three bicy-
     9  cle with electric assist if such bicycle  is  operated  outside  a  city
    10  having  a population of one million or more. Further, such peace officer
    11  shall transport the class three bicycle with  electric  assist  to  such
    12  officer's local station or a secure municipal impound facility, whichev-
    13  er is closest.
    14    12.  A violation of the provisions of subdivision two, five, six[,] or
    15  nine[, or ten] of this section shall result  in  a  civil  fine  not  to
    16  exceed fifty dollars.
    17    14.  A  violation of subdivision ten of this section shall result in a
    18  civil fine not to exceed fifty dollars and an administrative fee of  two
    19  hundred  fifty  dollars  for the first offense, five hundred dollars for
    20  the second offense and seven hundred fifty dollars for the third offense
    21  and every subsequent offense. A person shall not have  the  class  three
    22  bicycle  with  electric  assist returned to them pursuant to subdivision
    23  ten of this section until such civil  fine  and  administrative  fee  is
    24  paid.
    25    § 2. This act shall take effect immediately.
