AN ACT to amend the criminal procedure law, in relation to designating
fire marshals in the county of Suffolk as peace officers; and to
repeal certain provisions of such law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 61 of section 2.10 of the criminal procedure
2 law, as added by chapter 257 of the laws of 1992, is amended to read as
3 follows:
4 61. [Chief fire marshall, assistant chief fire marshall, fire marshall
5 II and fire marshall I, all of whom are full-time employees of the
6 Suffolk county department of fire, rescue and emergency services, when
7 acting pursuant to their special duties in matters arising under the
8 laws relating to fires, the extinguishment thereof and fire perils;
9 provided, however, that nothing in this subdivision shall be deemed to
10 authorize such officer to carry, possess, repair or dispose of a firearm
11 unless the appropriate license therefor has been issued pursuant to
12 section 400.00 of the penal law] Chief fire marshals, assistant chief
13 fire marshals, fire marshal IIs and fire marshal Is employed by the
14 county of Suffolk or a town or village therein.
15 § 2. Subdivision 62 of section 2.10 of the criminal procedure law, as
16 added by chapter 204 of the laws of 1993, is REPEALED.
17 § 3. Subdivision 63 of section 2.10 of the criminal procedure law, as
18 amended by chapter 638 of the laws of 2003, is REPEALED.
19 § 4. Subdivision 65 of section 2.10 of the criminal procedure law is
20 REPEALED.
21 § 5. Subdivision 71 of section 2.10 of the criminal procedure law is
22 REPEALED.
23 § 6. Subdivision 77 of section 2.10 of the criminal procedure law, as
24 added by chapter 367 of the laws of 2004, is REPEALED.
25 § 7. This act shall take effect immediately.
