CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
proposing an amendment to article 5 of the constitution, in relation to
establishing a state board of parole
1 Section 1. Resolved (if the Assembly concur), That article 5 of the
2 constitution be amended by adding a new section 8 to read as follows:
3 § 8. There shall be a state board of parole, responsible for determin-
4 ing which incarcerated individuals may be released from incarceration to
5 parole and establishing any conditions of release for such individuals.
6 The legislature shall determine the qualifications for such members and
7 the functions, powers, and duties of such board, other than those set
8 forth in this section. There shall be seventeen members of the state
9 board of parole, appointed as follows:
10 (1) one member, the head of the board of parole known as the commis-
11 sioner of the board of parole, shall be chosen by all voters in the
12 state at the same general election as the governor and hold office for
13 the same term;
14 (2) eleven members, one from each judicial district, chosen by the
15 voters in such judicial district at the same general election as the
16 governor, and shall hold office for the same term; and
17 (3) five members shall be appointed as follows:
18 (a) one member shall be appointed by the governor;
19 (b) one member shall be appointed by the temporary president of the
20 senate;
21 (c) one member shall be appointed by the minority leader of the
22 senate;
23 (d) one member shall be appointed by the speaker of the assembly; and
24 (e) one member shall be appointed by the minority leader of the assem-
25 bly.
26 § 2. Resolved (if the Assembly concur), That the foregoing be referred
27 to the first regular legislative session convening after the next
28 succeeding general election of members of the assembly, and, in conform-
29 ity with section 1 of article 19 of the constitution, be published for 3
30 months previous to the time of such election.
