        AN ACT to amend the urban development corporation act,  in  relation  to
          the  participation  of  the  corporation  in  projects pursuant to the
          Columbia University Education Mixed-Use Development Land Use  Improve-
          ment  and  Civic  Project Modified General Project Plan adopted by the
          empire state development corporation on December 18, 2008
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.   Legislative intent.   The legislature finds and declares
     2  that the project area identified in the  Columbia  University  Education
     3  Mixed-Use  Development  Land  Use Improvement and Civic Project Modified
     4  General Project Plan and surrounding neighborhoods are not a substandard
     5  nor insanitary area, nor in danger of becoming  substandard  or  insani-
     6  tary, and therefore do not require continued assistance and resources of
     7  the urban development corporation or the empire state development corpo-
     8  ration as authorized by the New York state urban development corporation
     9  act.
    10    §  2.  Section  10  of   section 1 of chapter 174 of the laws of 1968,
    11  constituting the urban development corporation act, is amended by adding
    12  a new subdivision (i) to read as follows:
    13    (i) in the  case  of  all  projects,  the  corporation  shall  not  be
    14  empowered  to  undertake  the acquisition, construction, reconstruction,
    15  rehabilitation or improvement of a project covered by section  ten-a  of
    16  this act.
    17    §  3.   Section 1 of chapter 174 of the laws of 1968, constituting the
    18  urban development corporation act, is amended by adding  a  new  section
    19  10-a to read as follows:
    20    §  10-a.  Participation  in certain projects. The corporation shall no
    21  longer be empowered to undertake the acquisition,  construction,  recon-
    22  struction,  rehabilitation or improvement of any project pursuant to the

     1  Columbia University Education Mixed-Use Development Land Use Improvement
     2  and Civic Project Modified General Project Plan adopted  by  the  empire
     3  state development corporation on December 18, 2008 or any modifications,
     4  amendments  or  additions  thereto. The provisions of this section shall
     5  not affect any acquisition, construction, reconstruction, rehabilitation
     6  or improvement for which a request for proposals is  open,  project  for
     7  which  a  contractual  commitment has been ratified, or public financing
     8  sources have explicitly been disbursed or provided prior to  the  effec-
     9  tive  date  of  this  section.  The provisions of this section shall not
    10  invalidate or impair the obligations of any entity other than the corpo-
    11  ration with respect to community benefits, including but not limited  to
    12  affordable  housing,  open  spaces, or civic amenity commitments made as
    13  part of or in connection with  the  modified  general  project  plan  or
    14  general project plan process.
    15    §  4.  No  later than six months after the effective date of this act,
    16  the urban development corporation, in consultation with  the  department
    17  of  economic  development  and the city of New York, shall submit to the
    18  governor, the temporary president of the senate, and the speaker of  the
    19  assembly,  a  report on the progress of all projects undertaken pursuant
    20  to the Columbia University  Education  Mixed-Use  Development  Land  Use
    21  Improvement  and  Civic Project Modified General Project Plan adopted by
    22  the empire state development corporation  on  December  18,  2008.  Such
    23  report  shall include, without limitation, details on any use of eminent
    24  domain, changes to zoning designation of any sites, and  any  agreements
    25  pertaining  to  payments  in lieu of taxes, including without limitation
    26  address information and total  public  assistance  provided  and  public
    27  assistance provided to each individual project.
    28    § 5. This act shall take effect immediately.
