AN ACT to amend the Nassau county civil divisions act, in relation to
the name and the funds of the corporation
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Sections 614.0, 614.1, 614.3 and 614.6 of the Nassau county
2 civil divisions act, as added by chapter 73 of the laws of 1940, are
3 amended to read as follows:
4 § 614.0 Incorporation. The membership corporation by the name of
5 "Alert Volunteer Exempt [Firemen's] Firefighter's Benevolent Associ-
6 ation, of Great Neck, New York," is hereby continued.
7 § 614.1 Persons eligible to membership. Any person who is now or here-
8 after becomes a member in good standing of the Alert Engine, Hook and
9 Ladder and Hose Company No. 1, of Great Neck, New York, and any person
10 residing in the area protected by such fire company who has reserved for
11 a period of five years as a volunteer member of such company and has
12 been honorably discharged therefrom, and any person residing in such
13 area who has received his certificate as an exempt [fireman] firefighter
14 from such company or from any other volunteer fire company, shall be
15 eligible to membership therein. Any [fireman] firefighter, however, who
16 has been removed for cause, expelled or dropped from the rolls of any
17 fire company or department shall not be eligible to membership in such
18 corporation.
19 § 614.3 Powers and duties. a. Such corporation shall have all of the
20 powers of a membership corporation, and the provisions of law relating
21 to membership corporations shall apply to such corporation except where
22 they conflict with the provisions of this article.
23 b. Such corporation shall have the power to become a member of any
24 state, county or national [firemen's] firefighter's association, organ-
25 ized for kindred purposes, now or hereafter created, and to pay dues
26 therein or contribute to the support thereof.
27 c. The Alert Engine, Hook and Ladder and Hose Company No. 1 may trans-
28 fer and convey to such corporation, with or without consideration, any

1 moneys or personal or real property now or hereafter owned by it, upon
2 the vote of two-thirds of the members of such engine, hook and ladder
3 and hose company present at any special meeting duly called by it for
4 such purpose.
5 § 614.6 Precept for payment of foreign fire insurance premium taxes.
6 a. Such corporation shall collect and there shall be paid to it all tax
7 imposed by section [five hundred fifty-three] nine thousand one hundred
8 four of the insurance law, for fire department use and benefit, upon
9 premiums on policies of insurance against loss or damage by fire cover-
10 ing property situated within the area protected by the Alert Engine,
11 Hook and Ladder and Hose Company No. 1 as now determined or as hereafter
12 extended.
13 b. The officer of such corporation designated by its by-laws to
14 collect and receive the aforesaid tax shall have the same powers as
15 provided by law for the treasurer of a fire department with respect to
16 such collection and receipt.
17 c. Such corporation shall also be entitled to receive a share of the
18 tax imposed by section [five hundred fifty-four] nine thousand one
19 hundred five of the insurance law, based upon the business written in
20 the territory with respect to which it is entitled to collect and
21 receive the tax under section [five hundred fifty-three] nine thousand
22 one hundred four of the insurance law.
23 d. Such taxes shall [be used only for the care and relief of disabled
24 or indigent volunteer and exempt firemen and their families] only be
25 used in furtherance of its purposes set forth in section 614.2 of this
26 act.
27 § 2. This act shall take effect immediately.
