        Introduced  by Sen. SCARCELLA-SPANTON -- read twice and ordered printed,
          and when printed to be committed to the Committee on Finance
 
        AN ACT to amend the executive law, in relation to extending term lengths
          for certain commissioners of deeds
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivisions 1 and 2 of section 139 of the executive law,
     2  as amended by chapter 550 of the laws of 1958, are amended  to  read  as
     3  follows:
     4    1.  Commissioners  of  deeds  in  the  cities  of  this state shall be
     5  appointed by the common councils of such cities respectively, and  shall
     6  hold  office  for  the  term  of [two] four years from the date of their
     7  appointment, and until others are appointed in their places.  A  vacancy
     8  occurring during the term for which any commissioner shall be appointed,
     9  shall be filled by the common council. The common council of the several
    10  cities of this state, except in cities of this state situate in a county
    11  which  has  a population of not less than one hundred [and] eighty thou-
    12  sand, and not more than six hundred [and] fifty thousand,  according  to
    13  the  last  state or federal enumeration, shall at the end of every other
    14  even numbered year, by resolution of the board, determine the number  of
    15  commissioners of deeds to be appointed for such cities respectively.
    16    2.  The  term of office of each commissioner of deeds appointed by the
    17  common council in cities of this state situate in a county which  has  a
    18  population  of  not less than one hundred [and] eighty thousand, and not
    19  more than six hundred [and] fifty thousand, according to the last  state
    20  or  federal enumeration, shall expire on the thirty-first of December of
    21  the second even numbered year next after [he] such commissioner shall be
    22  appointed.  The common council of any such city shall in  the  month  of
    23  November in every other even numbered year, by resolution, determine the
    24  number of commissioners of deeds to be appointed in such cities, respec-
    25  tively, for the next succeeding [two] four years.
    26    §  2. Subdivision 1 of section 140 of the executive law, as amended by
    27  chapter 376 of the laws of 1953, is amended to read as follows:

     1    1. The council of the city of New York is  hereby  authorized  and  is
     2  empowered  to  appoint  commissioners of deeds in such city from time to
     3  time, who shall hold their offices for [two] four years from the date of
     4  their appointment.
     5    § 3. This act shall take effect immediately.
