Expands the residency requirement for the village clerk, deputy village clerk, village treasurer, and deputy village treasurer of the village of Washingtonville such that such person need not be a resident of such village, but must be a resident in the county in which such village is located or an adjoining county within the state of New York.

AN ACT to amend the village law and public officers law, in relation to
the residency of certain officers of the village of Washingtonville,
Orange county
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3-300 of the village law is amended by adding a new
2 subdivision 37 to read as follows:
3 37. Notwithstanding any provisions of this chapter or any other chap-
4 ter, general law, local law, ordinance, or special act, the village
5 board of trustees of the village of Washingtonville, Orange county, may,
6 by resolution, provide that the village clerk, deputy village clerk,
7 village treasurer, and deputy village treasurer of the village of Wash-
8 ingtonville need not be a resident of such village, but must be a resi-
9 dent in the county in which such village is located or an adjoining
10 county within the state of New York. Provided, however, the person
11 performing the functions of village clerk, deputy village clerk, village
12 treasurer, and deputy village treasurer in any other village shall be a
13 resident of such village, unless otherwise provided by an act of the
14 state legislature.
15 § 2. Section 3 of the public officers law is amended by adding a new
16 subdivision 77 to read as follows:
17 77. In the village of Washingtonville, in the county of Orange, the
18 provisions of this section requiring a person to be a resident of the
19 political subdivision or municipal corporation of the state for which
20 such person shall be chosen or within which such person's official func-
21 tions are required to be exercised, shall not prevent such person from
22 holding the office of village clerk, deputy village clerk, village trea-
23 surer, or deputy village treasurer of the village of Washingtonville,
24 provided that such person resides in Orange county or an adjoining coun-
25 ty within the state of New York. Provided, however, the person perform-
26 ing the functions of village clerk, deputy village clerk, village treas-
27 urer, and deputy village treasurer in any other village shall be a
28 resident of such village unless otherwise provided by law.
29 § 3. This act shall take effect immediately.
