        Introduced  by  Sen. JACKSON -- read twice and ordered printed, and when
          printed to be committed to the Committee on Higher Education
 
        AN ACT directing the chair of the board of trustees of the city  univer-
          sity  of  New York shall conduct an audit of such university's partic-
          ipation in retirement systems
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. (a) The chair of the board of trustees of the city univer-
     2  sity of New York shall conduct an audit  of  such  university's  partic-
     3  ipation  in  retirement  systems  pursuant  to section sixty-two hundred
     4  fourteen and article one hundred  twenty-five-A  of  the  education  law
     5  covering  from  1998 to the present. Such audit shall examine retirement
     6  enrollment, management, contributions and employee payroll deductions of
     7  the city university of New York.  Such audit shall include:
     8    1. processes for enrollment at each  college,  school,  and  the  city
     9  university's central office;
    10    2. processes for contributions and employee payroll deductions at each
    11  college, school, and the city university's central office;
    12    3.  all  lapses in retirement plan enrollment wherein an employee with
    13  an appointment was not enrolled in the retirement system; and
    14    4. all lapses wherein the city university did not  make  contributions
    15  or employee payroll deductions for an employee with an appointment.
    16    (b)  As  part  of  the audit process the board of trustees of the city
    17  university of New York shall establish a non-proprietary database avail-
    18  able for public use that will list the following  information  for  each
    19  lapse  in retirement plan enrollment, contributions, or employee payroll
    20  deductions, per employee, by unique employee identifier:
    21    1. the individual employees affected;
    22    2. the location of employment, whether that  be  college,  school,  or
    23  city university's central office;
    24    3. the beginning and end dates of each lapse; and
    25    4.  the  total  dollar  amount  of  lapsed  contributions, or employee
    26  payroll deductions, during  the  period  of  the  lapse  of  enrollment,
    27  contribution, or employee payroll deduction.

     1    (c)  Subsequent to the initial audit conducted pursuant to subdivision
     2  (a) of this section, the board of trustees of the city university of New
     3  York shall conduct such audit annually and release a report by  February
     4  first covering the prior calendar year.
     5    §  2.  Within one year of the effective date of this act, the chair of
     6  the board of trustees of the city university of New York  shall  make  a
     7  report to the governor and the legislature of its findings, conclusions,
     8  recommendations,  including recommendations to prevent lapses in enroll-
     9  ment, contributions, and employee payroll deductions, activities already
    10  undertaken by the board of trustees of the city university of  New  York
    11  to  correct  deficiencies  found  by  the  audit,  and  any  legislative
    12  proposals as deemed necessary to  implement  its  recommendations.  Such
    13  report  shall  also  be made available on the public website of the city
    14  university of New York.
    15    § 3. This act shall take effect immediately.
