AN ACT to amend the judiciary law, in relation to requiring the office
of court administration to publish an annual report regarding cases
involving property/casualty insurance companies and insureds
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 212 of the judiciary law is
2 amended by adding a new paragraph (ff) to read as follows:
3 (ff) (i) On or before the fifteenth day of March of each year, submit
4 to the governor, the senate, the assembly, the chair of the senate
5 committee on insurance, the chair of the assembly committee on insur-
6 ance, and the superintendent of the department of financial services a
7 report concerning cases involving property/casualty insurance companies,
8 as such term is defined in section one hundred seven of the insurance
9 law, and their insureds which were settled or where a judgement was
10 reached during the preceding year.
11 (ii) Such report shall include, but not be limited to, for each case
12 in the report:
13 (A) the date of the first legal filing involved in the case;
14 (B) the date when the settlement or judgement is reached;
15 (C) whether the result is a settlement or a judgement;
16 (D) the amount of the settlement or judgement;
17 (E) whether third-party litigation funding had been utilized;
18 (F) the name of the insurance company involved;
19 (G) what type of policy coverage is involved or in question;
20 (H) whether the settlement or judgement was reached in mediation, by a
21 judge, or by a jury;
22 (I) in which court the case was brought;
23 (J) the name of the judge assigned to the case; and
24 (K) any other information the chief administrator of the courts deems
25 relevant to the report.
26 § 2. This act shall take effect immediately.
