AN ACT to amend the state finance law, in relation to authorizing state
agencies to reserve or set aside certain procurements for businesses
owned by women and minorities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 4 of section 163 of the state finance law is
2 amended by adding a new paragraph h to read as follows:
3 h. Notwithstanding any provision of law to the contrary, a state agen-
4 cy may provide for the reservation or set-aside of certain procurements
5 for business enterprises defined in subdivision seven, fifteen and/or
6 twenty of section three hundred ten of the executive law; provided,
7 however, that such procurements shall remain subject to: (i) priority of
8 preferred sources pursuant to this section and section one hundred
9 sixty-two of this article; (ii) the approval of the comptroller of the
10 state of New York pursuant to section one hundred twelve of this chap-
11 ter, and section twenty-eight hundred seventy-nine-a of the public
12 authorities law and this section; and (iii) the procurement record
13 requirements pursuant to paragraph g of subdivision nine of this
14 section.
15 § 2. This act shall take effect immediately; provided, however, that
16 the amendments to section 163 of the state finance law made by section
17 one of this act shall not affect the repeal of such section and shall be
18 deemed repealed therewith.
