        Introduced  by  Sen. ROLISON -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
 
        AN ACT to amend the vehicle and traffic law, in relation to  authorizing
          the issuance of distinctive plates for medical technologists
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 404-ff to read as follows:
     3    § 404-ff. Distinctive plates for medical technologists. 1. Any medical
     4  technologist  shall, upon request, be issued a license plate bearing the
     5  emblem and words "New York State" on the top of the  license  plate  and
     6  "Medical  Technologist"  on the bottom of the license plate. Application
     7  for said license plate shall be filed with the commissioner in such form
     8  and detail as the commissioner shall prescribe  and  shall  be  verified
     9  annually by the applicant.
    10    2. The distinctive plate authorized in subdivision one of this section
    11  shall  be  issued upon proof, satisfactory to the commissioner, that the
    12  applicant is presently a medical technologist.
    13    3. A distinctive plate issued pursuant to this section shall be issued
    14  in the same manner as other number plates upon payment  of  the  regular
    15  registration fee prescribed by section four hundred one of this article,
    16  provided,  however,  that an additional annual service charge of fifteen
    17  dollars shall be charged for such plate.
    18    § 2. 1. A distinctive plate established pursuant to section 404-ff  of
    19  the  vehicle and traffic law shall only be designed, produced and issued
    20  upon the delivery to the department of motor vehicles of a  surety  bond
    21  in  the  amount  of  $6,000, which shall be executed by a surety company
    22  authorized by the department of financial services to transact  business
    23  in  this  state.  Provided,  however,  that if the commissioner of motor
    24  vehicles shall have received prior to plate design, production and issu-
    25  ance at least 200 orders for such distinctive plate  together  with  the
    26  additional  annual  service  charge applicable to each such order, which
    27  shall be non-refundable, no such surety  bond  shall  be  required.  All
    28  service  charges  collected  pursuant to this section shall be deposited

     1  pursuant to the provisions of section 404-oo of the vehicle and  traffic
     2  law  to the credit of the department of motor vehicles distinctive plate
     3  development fund established by section 95-g of the  state  finance  law
     4  and  shall  be used for the design, production, advertising and distrib-
     5  ution of distinctive license plates  in  accordance  with  such  section
     6  95-g.
     7    2.  If, upon the expiration of two years following the date upon which
     8  distinctive plates in the series are first available for  sale,  200  or
     9  more  sets  of  such  plates are sold, a bond delivered pursuant to this
    10  section shall be discontinued. If fewer than 200 sets of such plates are
    11  sold by such time, the department of motor vehicles shall be entitled to
    12  recover against the bond in an amount proportionate to such shortfall.
    13    § 3. This act shall take effect on the one hundred eightieth day after
    14  it shall have become a law. Effective immediately, the addition,  amend-
    15  ment and/or repeal of any rule or regulation necessary for the implemen-
    16  tation  of  this act on its effective date are authorized to be made and
    17  completed on or before such effective date.
