AN ACT authorizing the commissioner of transportation to extend a lease
of certain state lands located in the hamlet of Farmingdale, town of
Babylon, county of Suffolk, state of New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding the provisions of section 3 of the public
2 lands law or any other law to the contrary, the commissioner of trans-
3 portation is hereby authorized to enter into and execute a one-time
4 extension of an existing lease of state-owned lands located at 1 and 2
5 Marriott Plaza, in the hamlet of Farmingdale, town of Babylon, county of
6 Suffolk, state of New York, which lands are under the jurisdiction and
7 control of the department of transportation.
8 Such lease extension shall:
9 (a) Be limited to a single extension of the current lease and existing
10 lease options;
11 (b) Be for a term not to exceed twenty years;
12 (c) Be upon such terms and conditions as the commissioner of transpor-
13 tation shall deem appropriate and in the best interests of the state;
14 and
15 (d) Be subject to the approval of the director of the budget and the
16 office of the attorney general as to form and manner of execution.
17 § 2. The lands authorized to be subject to such lease extension are
18 state-owned lands known as 1 and 2 Marriott Plaza, Farmingdale, New
19 York, being lands under the jurisdiction of the department of transpor-
20 tation, and more particularly described in the existing lease agreement
21 on file with such department.
22 § 3. The authority granted by this act shall apply solely to the lease
23 extension described herein and shall not be deemed to authorize the
24 sale, transfer, or any additional lease or extension of any other state
25 lands without further express authorization of the legislature pursuant
26 to section 3 of the public lands law.
27 § 4. This act shall take effect immediately.
