        AN ACT to amend the vehicle and traffic  law,  in  relation  to  waiving
          metered  parking  fees  for  certain vehicles displaying a handicapped
          permit or with handicapped plates
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 1203-h of the vehicle and traffic law, as added by
     2  chapter 243 of the laws of 2007, is amended to read as follows:
     3    § 1203-h. Metered parking [waiver] waived for certain disabilities. 1.
     4  [The commissioner shall distribute metered parking waiver permits to the
     5  governing bodies of all cities, villages and towns;  provided,  however,
     6  that the commissioner shall not distribute such permits to cities having
     7  a  population  of  one million or more which issue special vehicle iden-
     8  tification parking permits pursuant to paragraph fifteen of  subdivision
     9  a  of  section  twenty-nine  hundred  three of the New York city charter
    10  which waive the payment of metered parking  fees.]  Notwithstanding  any
    11  local law or ordinance to the contrary, [such] parking permits for hand-
    12  icapped  persons  issued  by  a  municipality  of  the state pursuant to
    13  section twelve hundred three-a of this article and plates  issued  to  a
    14  severely disabled person under section four hundred four-a of this chap-
    15  ter  shall  entitle any vehicle displaying such [waiver] permit or plate
    16  to park at any metered parking space in any city, village or town of the
    17  state and such permits and  plates  shall  waive  metered  parking  fees
    18  imposed  by  such city or village pursuant to paragraph nine of subdivi-
    19  sion (a) of section sixteen hundred forty of this chapter or imposed  by
    20  such  town  pursuant  to  paragraph  nine  of subdivision (a) of section
    21  sixteen hundred sixty of this chapter.   Provided,  however,  that  such
    22  permit  or  plate  shall  not  waive any time limit at a metered parking
    23  space imposed pursuant to paragraph nine of subdivision (a)  of  section
    24  sixteen  hundred  forty of this chapter or paragraph nine of subdivision
    25  (a) of section sixteen hundred sixty of this chapter that is  applicable
    26  to  a  motor  vehicle parking in such metered parking space without such
    27  permit or plate.

     1    2. [The application, permit design, period of validity, and procedures
     2  for reissuance of such waiver permits shall  be  as  determined  by  the
     3  commissioner.
     4    3.  Such  waiver  permits  shall be issued by issuing agents appointed
     5  pursuant to subdivision one of section twelve hundred  three-a  of  this
     6  article by governing bodies of cities, villages and towns having a popu-
     7  lation of less than one million to persons with disabilities who:
     8    (a) are residents of New York state; and
     9    (b)  are  residents of the city, town or village in which such issuing
    10  agent is  located,  except  that,  an  issuing  agent,  in  his  or  her
    11  discretion,  may issue a permit to a severely disabled person who is not
    12  a resident of the city, town, or village in which such issuing agent  is
    13  located  where  such person resides in a city, town, or village in which
    14  the governing body has not appointed an issuing agent; and
    15    (c) hold a valid driver's license issued by New York state; and
    16    (d) are severely disabled persons, as defined in subdivision  four  of
    17  section four hundred four-a of this chapter, whose severe disability, as
    18  certified by a licensed physician, limits one or more of the following:
    19    (i) fine motor control in both hands;
    20    (ii) ability to reach or access a parking meter due to use of a wheel-
    21  chair or other ambulatory device; or
    22    (iii)  ability  to  reach a height of forty-two inches from the ground
    23  due to the lack of finger, hand or upper extremity strength or mobility.
    24    4. For the purposes of this section, such waiver permit shall  be  for
    25  use  exclusively  in  a  vehicle] This section shall only apply when the
    26  person to whom [it] such permit or plate has been issued is driving  and
    27  unaccompanied  by  a  person  able  to put payment into a parking meter.
    28  [Such permit shall not be transferable and shall be forfeited if used by
    29  any other person. Any abuse by any person to whom such waiver permit has
    30  been issued shall be sufficient cause for revocation of said permit.
    31    5. The special metered parking waiver permit issued by the commission-
    32  er shall be recognized statewide and is the  only  valid  permit,  other
    33  than  a  special  vehicle identification parking permit issued by cities
    34  having a population of one million or more pursuant to paragraph fifteen
    35  of subdivision a of section twenty-nine hundred three of  the  New  York
    36  city charter, for the waiver of metered parking fees for certain severe-
    37  ly disabled drivers.
    38    6.]  3.  A  person  who  knowingly  and  willfully, with the intent to
    39  deceive, makes a false statement or gives information which  such  indi-
    40  vidual knows to be false to a public official to [obtain a metered park-
    41  ing  waiver permit] have metered parking fees waived under this section,
    42  in addition to any other penalty provided by law, shall be subject to  a
    43  civil  penalty  of not less than two hundred fifty dollars nor more than
    44  one thousand dollars.
    45    § 2. This act shall take effect on the ninetieth day  after  it  shall
    46  have become a law. Effective immediately, the addition, amendment and/or
    47  repeal  of  any  rule  or regulation necessary for the implementation of
    48  this act on its effective date are authorized to be made  and  completed
    49  on or before such effective date.
