        Introduced by Sen. SEPULVEDA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
 
        AN  ACT to amend the civil rights law, in relation to establishing civil
          liability for the deprivation of any rights, privileges, or immunities
          secured by the federal or state constitution
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  civil  rights law is amended by adding a new section
     2  79-r to read as follows:
     3    § 79-r. Deprivation of constitutional rights,  privileges  or  immuni-
     4  ties;  civil  liability.  Every  person who, under color of any statute,
     5  ordinance, regulation, custom, or usage, of the United States,  subjects
     6  or  causes  to  be  subjected, any citizen of this state or other person
     7  within the jurisdiction thereof to the deprivation of any rights, privi-
     8  leges, or immunities secured by the constitution of the United States or
     9  the constitution of the state of New York, shall be liable to the  party
    10  injured  in an action at law, suit in equity, or other proper proceeding
    11  for redress.
    12    § 2. This act shall take effect on the ninetieth day  after  it  shall
    13  have become a law.
