AN ACT to amend the transportation law, in relation to establishing an
interactive website for reporting defects on public highways
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 14 of the transportation law is amended by adding a
2 new subdivision 37 to read as follows:
3 37. (a) For the purposes of this subdivision, the term "defect" shall
4 include, but not be limited to, bad road condition, potholes, tall
5 grass, graffiti, roadway debris, litter, animal carcasses, issues with
6 traffic control devices or road signage, guardrail damage, and necessary
7 maintenance.
8 (b) The commissioner shall establish an interactive website by which
9 persons may report the locations of defects of public highways and
10 receive, at such person's request, notification when repairs to the
11 reported defect have been completed or, where the reported defect is not
12 on a state highway system or the New York state thruway, notification
13 when information regarding the reported defect has been transmitted to
14 the municipality responsible for such public highway. The commissioner
15 shall also post the locations of each reported defect on the state high-
16 way system or the New York state thruway on such interactive website
17 until such time as such defect is repaired. The commissioner shall also
18 inform municipalities when a defect is reported on a public highway
19 which is the responsibility of such municipality.
20 § 2. This act shall take effect on the one hundred twentieth day after
21 it shall have become a law. Effective immediately, the addition, amend-
22 ment and/or repeal of any rule or regulation necessary for the implemen-
23 tation of this act on its effective date are authorized to be made and
24 completed on or before such effective date.
