AN ACT to amend the insurance law, in relation to imposing standards for
certain examination services
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 1 of subsection (f) of section 2103 of the insur-
2 ance law, as amended by chapter 65 of the laws of 1998, is amended to
3 read as follows:
4 (1) (A) The superintendent shall, in order to determine the competency
5 of every individual applicant and of every proposed sub-licensee to have
6 the kind of license applied for, require such individual to submit to a
7 personal written examination and to pass the same to the satisfaction of
8 the superintendent. Such examination shall be held at such times and
9 places as the superintendent shall from time to time determine. Every
10 individual applying to take any written examination shall, at the time
11 of applying therefor, pay to the superintendent, or, at the discretion
12 of the superintendent, directly to any organization that is under
13 contract to provide examination services, an examination fee of an
14 amount which is the actual documented administrative cost of conducting
15 said qualifying examination as certified by the superintendent from time
16 to time. An examination fee represents an administrative expense and is
17 not refundable. The superintendent may accept, in lieu of any such exam-
18 ination, the result of any previous written examination, given by the
19 superintendent, which in [his] their judgment is equivalent to the exam-
20 ination for which it is substituted.
21 (B) Any organization that is under contract to provide examination
22 services consistent with subparagraph (A) of this paragraph shall devel-
23 op, administer, and score such examinations in accordance with the stan-
24 dards and best practices developed by the national association of insur-
25 ance commissioners; provided, however, if the superintendent adopts a
26 regulation imposing a different standard, such organization under
27 contract to provide examination services shall comply with such adopted
28 standard.
29 § 2. This act shall take effect immediately and shall apply to all
30 examinations conducted on or after such date.
