Provides that reimbursement payable for grants for nonpublic school safety equipment shall be paid within twelve months of the nonpublic school furnishing all required application materials for such grant to the department of education; requires the commissioner of education to report on any such reimbursements payable.

AN ACT to amend the education law, in relation to reimbursement for
nonpublic school safety equipment grants
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 305 of the education law is amended by adding a new
2 subdivision 63 to read as follows:
3 63. a. Notwithstanding any inconsistent provision of law, any
4 reimbursement payable to a nonpublic school for nonpublic school safety
5 equipment grants administered by the commissioner shall be paid within
6 twelve months of the nonpublic school furnishing all required applica-
7 tion materials for such grant to the department.
8 b. The commissioner, in conjunction with the office of religious and
9 independent schools, shall biannually report upon any reimbursements
10 payable pursuant to paragraph a of this subdivision that have not been
11 paid within twelve months of the nonpublic school furnishing all
12 required application materials for such grant to the department. Such
13 report shall include, but not be limited to the following information:
14 the name of the school that has not been reimbursed, the current
15 outstanding reimbursement amount, and the original date on which the
16 nonpublic school furnished all required application materials for such
17 grant to the department, provided that if the nonpublic school submitted
18 application materials over multiple dates, the department shall report
19 only the date on which the final required materials were received by the
20 department. Such report shall be delivered to the governor, the comp-
21 troller, the temporary president of the senate, the speaker of the
22 assembly, the chair of the senate education committee, and the chair of
23 the assembly education committee by May first and November first of each
24 year.
25 c. Nothing in this subdivision shall be construed to apply to any
26 grant funding awarded on a competitive basis.
27 § 2. This act shall take effect April 1, 2027.
