ROLISON -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to classifying criminal possession of a firearm from a class E felony to a class D felony The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 265.01-b of the penal law, as added by chapter 1 of 2 the laws of 2013, is amended to read as follows: 3 § 265.01-b Criminal possession of a firearm. 4 A person is guilty of criminal possession of a firearm when [he or5she] such person: (1) possesses any firearm or; (2) lawfully possesses 6 a firearm prior to the effective date of [the] chapter one of the laws 7 of two thousand thirteen [which added this section] subject to the 8 registration requirements of subdivision sixteen-a of section 400.00 of 9 this chapter and knowingly fails to register such firearm pursuant to 10 such subdivision. 11 Criminal possession of a firearm is a class [E] D felony. 12 § 2.
