AN ACT to amend the vehicle and traffic law, in relation to the safety
and emissions inspections of new motor vehicles
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision (a) of section 301 of the vehicle and traffic
2 law, as amended by chapter 429 of the laws of 1998, is amended to read
3 as follows:
4 (a) The commissioner shall require that every motor vehicle registered
5 in this state be inspected once each year for safety, and at least bien-
6 nially for emissions as provided for pursuant to paragraph two of subdi-
7 vision (d) of this section, and in accordance with the provisions of
8 this article, [and] except that [every] a new motor vehicle sold or
9 transferred for use on the public highways of the state by a dealer
10 registered under section four hundred and fifteen of this chapter which
11 is inspected and registered by the dealer upon sale or transfer as
12 provided for herein shall not be required to obtain a safety or emis-
13 sions inspection until the third year after such initial inspection by
14 the dealer. Every motor vehicle sold or transferred for use on the
15 public highways of this state by a dealer registered under section four
16 hundred fifteen of this chapter to any person other than another such
17 registered dealer or transferred for no remuneration by such a regis-
18 tered dealer to any person other than to a welfare to work program
19 authorized by the New York state department of labor, a private industry
20 council, a county or a social services district for the sole use of
21 public assistance recipients or applicants participating in the welfare
22 to work program to which such vehicle is transferred must be inspected
23 and bear a valid certificate or certificates of inspection prior to
24 delivery to the purchaser or transferee. Provided, however, that nothing
25 contained herein shall be deemed to exempt any motor vehicle so trans-
26 ferred to a welfare to work program pursuant to the provisions of this
27 subdivision from being inspected in accordance with the provisions of
28 this section or from complying with all other applicable provisions of
29 this chapter, including registration and financial security, prior to
30 operation on any public highway.
31 § 2. This act shall take effect immediately.
