AN ACT to amend the penal law and the correction law, in relation to
increasing penalties for promoting prison contraband and screening
protocols at correctional facilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. This act shall be known and may be cited as the "correc-
2 tional facility protection act".
3 § 2. Subdivision 4 of section 205.00 of the penal law is amended to
4 read as follows:
5 4. "Dangerous contraband" means contraband which is capable of such
6 use as may endanger the safety or security of a detention facility or
7 any person therein which shall include, but shall not be limited to
8 firearms and other dangerous weapons defined in section 265.00 of this
9 part, destructive devices defined in section 265.00 of this part, and
10 controlled substances defined in section 220.00 of this part.
11 § 3. The closing paragraph of section 205.20 of the penal law is
12 amended to read as follows:
13 Promoting prison contraband in the second degree is a class [A misde-
14 meanor] E felony.
15 § 4. The closing paragraph of section 205.25 of the penal law is
16 amended to read as follows:
17 Promoting prison contraband in the first degree is a class [D] C felo-
18 ny.
19 § 5. Section 112 of the correction law is amended by adding two new
20 subdivisions 8 and 9 to read as follows:
21 8. (a) The commissioner shall require that each correctional facility
22 utilize body imaging scanning equipment to screen all incarcerated indi-
23 viduals and visitors who seek to enter such correctional facility. Such
24 scanning shall be mandatory for any visitor seeking a contact visit.
25 (b) For the purposes of this subdivision, "body imaging scanning
26 equipment" shall mean equipment that utilizes a low dose of ionizing

1 radiation to produce an anatomical image capable of detecting objects
2 placed on, attached to, or secreted within a person's body.
3 9. The commissioner shall establish a contraband screening plan which
4 shall include the use of a leashed and controlled canine trained to
5 detect illegal drugs at the entrance of each correctional facility. All
6 visitors, bags, and items entering the facility shall be subject to
7 screening by such canine.
8 § 6. This act shall take effect immediately.
