  TITLE OF BILL: An act to amend the general municipal law, in relation to prohibiting levies, charges, taxes or assessments on any property which uses private well water or a septic system where a municipal or joint water or sewer district exists or is established   PURPOSE: This bill would prohibit levies, charges, taxes, or assessments on.any property which uses private well water or a septic system when a munici- pal or joint water or sewer district is established or exists.   SUMMARY OF PROVISIONS: Section 1 prohibits taxes on any property which uses private well water as its water supply where a municipal water district or a joint water district exists or is formed. Section 1 also prohibits taxes on any property which uses a septic system for the treatment of wastewater where a municipal sewer district or a joint sewer district exists or is formed. Section 2 of the bill sets forth the effective date.   JUSTIFICATION: Generally, the formation of a water or sewer district allows the district to assess a charge or tax on properties that are located within the boundaries of then existing or newly formed district, regardless of if the property is using well water or a septic system. This legis- lation is necessary to protect property owners who do not need access to such services since they already have access to a well and/or septic system. Property owners are responsible for operating, maintaining, and replacing septic systems at their own expense. It is unfair to tax prop- erty owners for a service they do not get.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS: None to the state.   EFFECTIVE DATE: This act shall take effect immediately.
