TITLE OF BILL:
An act to amend the real property actions and proceedings law, in
relation to requiring a petition in a summary proceeding to recover
possession of real property in the city of Newburgh to allege proof of
compliance with local laws requiring rental residential property
registration and licensure
 
PURPOSE OR GENERAL IDEA OF BILL:
To require a property owner to allege proof of compliance with the City
of Newburgh's rental registry laws as a condition of bringing an
eviction petition in the City Court.
 
SUMMARY OF PROVISIONS:
Section 1 amends subdivision 6 of section 741 of the Real Property
Actions and Proceedings Law by adding the City of Newburgh to the
provisions of this section.
Section 2 sets forth the effective date which is on the ninetieth day
after it becomes a law.
 
JUSTIFICATION:
One of a municipality's most important responsibilities is enforcing its
building code. This is especially true in the City of Newburgh where
more than two-thirds of the residents live in rental housing. In 2018,
the City of Newburgh, to help enforce its building code, passed a land-
lord registry requirement. Unfortunately, many landlords have failed to
comply with the law. This lack of compliance means that many residents
continue to live in subpar housing. The situation, compounded by the
lack of available and affordable housing, leaves tenants with virtually
no options to find better living situations.
By requiring landlords to register as a condition of allowing them.to
evict tenants, they will have an immediate, monetary incentive to comply
with the law. As a result, the City of Newburgh will be able to track
down landlords and better enforce its building code, resulting in safer,
healthier living conditions. for renters and a more habitable city for
all.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become a law.

AN ACT to amend the real property actions and proceedings law, in

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 741 of the real property actions and proceedings
2 law is amended by adding a new subdivision 7 to read as follows:
3 7. In the city of Newburgh, where the premises from which removal is
4 sought is subject to a local law requiring the registration of said
5 premises as a condition of legal rental, allege proof of compliance with
6 such local law.
7 § 2. This act shall take effect on the ninetieth day after it shall
8 have become a law.
