  TITLE OF BILL: An act to amend chapter 535 of the laws of 1968 relating to the incorpo- ration of the Deer Park Volunteer Exempt Firemen's Benevolent Associ- ation, and providing for its powers and duties, in relation to the source of tax revenues paid to such association for fire department use and benefit   PURPOSE OR GENERAL IDEA OF BILL: Relates to the source of tax revenues paid to the Deer Park Volunteer Exempt Firemen's Benevolent Association for fire department use and benefit   SUMMARY OF PROVISIONS: Section 1: Section 7 of chapter 535 of the laws of 1968, relating to the incorporation of the Deer Park Volunteer Exempt Firemen's Benevolent Association, and providing for its powers and duties, is amended Section 2: establishes the effective date.   JUSTIFICATION: The Deer Park Volunteer Exempt Firemen's Benevolent Association receives Foreign Fire insurance Premium Tax monies from the New York State Insur- ance Department. Currently, they are authorized to use such funds for the care and relief of injured, disabled, or indigent volunteers and exempt firefighters and their families. This legislation would authorize the Association to use the funds in the furtherance of all their statu- tory purposes. This act would amend the chapter of law governing ,the operation of the Deer Park Volunteer Exempt Firemen's Benevolent Association in a manner similar to that which has been done for other volunteer firefighters' benevolent associations, so that it may more effectively attend to the well-being of the association, its members and their families.   PRIOR LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None to state.   EFFECTIVE DATE: This act shall take effect immediately

        Introduced by M. of A. K. BROWN -- read once and referred to the Commit-

        AN ACT to amend chapter 535 of the laws of 1968 relating to the incorpo-
          ration of the Deer Park Volunteer Exempt Firemen's Benevolent  Associ-
          ation,  and  providing  for  its powers and duties, in relation to the
          source of tax revenues paid to such association  for  fire  department
          use and benefit
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 7 of chapter 535 of the laws of 1968,  relating  to
     2  the incorporation of the Deer Park Volunteer Exempt Firemen's Benevolent
     3  Association, and providing for its powers and duties, is amended to read
     4  as follows:
     5    § 7. Precept for payment of foreign fire insurance premium taxes. Such
     6  corporation  shall  collect  and  there  shall  be  paid to it all taxes
     7  imposed by section [five hundred fifty-three] 9104 of the insurance  law
     8  for fire department use and benefit, upon premiums for insurance against
     9  loss  or  damage by fire covering property situated within the territory
    10  protected by the Deer Park fire department, located in the town of Baby-
    11  lon, Suffolk county, New York, viz: within the bounds of the  Deer  Park
    12  fire  district,  or within any specifically described territory in which
    13  the Deer Park fire department may hereafter  be  obligated,  by  written
    14  contract,  to  render  fire  protection. The officer of said corporation
    15  designated by its by-laws to collect and receive the aforesaid tax shall
    16  have all the powers and be subject to all the provisions of  the  insur-
    17  ance  law,  relating to treasurers of fire departments. Such corporation
    18  shall also be entitled to receive a share of the tax imposed by  section
    19  [five  hundred  fifty-four]  9105  of  the insurance law, based upon the
    20  business written in the territory with respect to which it  is  entitled
    21  to  collect and receive the tax under section [five hundred fifty-three]
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  9104 of the insurance law. [Such taxes shall only be used for  the  care
     2  and  relief of disabled or indigent volunteer and exempt volunteer fire-
     3  men and their families.] Such taxes shall only be  used  by  the  corpo-
     4  ration  in  furtherance of its purposes as set forth under section three
     5  of this act.
     6    § 2. This act shall take effect immediately.
