TITLE OF BILL:
An act to amend the penal law, in relation to permitting certain
licensed individuals to purchase or take possession of ammunition with-
out requiring contacting the statewide license and record database
 
PURPOSE OR GENERAL IDEA OF BILL:
Permits certain licensed individuals to purchase or take possession of
ammunition without requiring contacting the statewide license and record
database
 
SUMMARY OF PROVISIONS:
Section 1. The opening paragraph of subdivision 2 of section 400.02 of
the penal law, as added by chapter 371 of the laws of 2022
Section 2. The opening paragraph of subdivision 3 of section 400.03 of
the penal law, as added by chapter 1 of the laws of 2013
 
JUSTIFICATION:
Licensed individuals with a pistol permit and semi-automatic rifle
endorsement have already been through a significant background check and
are required to recertify that permit. Both pistol permit holders, and
those with hunting licenses, have proven their ability to safely carry
firearms and ammunition by taking New York State courses approved by the
Department of Environmental Conservation. This legislation would exempt
such licensed individuals from the duplicate background check and fees
being imposed.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
None to the state.
 
EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law
