TITLE OF BILL:
An act to amend the agriculture and markets law, in relation to funding

2023 amending the agriculture and markets law relating to establishing
the agrivoltaics research program, as proposed in legislative bills
numbers S. 7081 and A. 4911, in relation to the effectiveness thereof
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would clarify that the agrivoltaics study program established
by Chapter 712 of the Laws of 2023 will be funded by appropriations made
to this program in the 2023-24 SFY Budget, clarifies that the State may
allocate more funds to this program in the future, and sets forth a
repeal date of December 31, 2030.
 
SUMMARY OF PROVISIONS:
Section 1 amends § 151-j of the Agriculture and Markets Law. Section 2
establishes the effective date.
 
JUSTIFICATION:
This legislation clarifies that the agrivoltaics research program,
established pursuant to Chapter 712 of the Laws of 2023 at Cornell
University, will be funded by appropriations already made available to
this program through 2023-24 SFY Budget. In addition, this bill would
clarify that funds may be appropriated to this program in the future,
and sets forth a sunset date of December 31, 2030.

EFFECTIVE DATE:
This act shall take effect immediately, provided, however section one of

AN ACT to amend the agriculture and markets law, in relation to funding
for the agrivoltaics research program; to amend a chapter of the laws
of 2023 amending the agriculture and markets law relating to estab-
lishing the agrivoltaics research program, as proposed in legislative
bills numbers S. 7081 and A. 4911, in relation to the effectiveness
thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 151-j of the agriculture and markets law, as added
2 by a chapter of the laws of 2023 amending the agriculture and markets
3 law relating to establishing the agrivoltaics research program, as
4 proposed in legislative bills numbers S. 7081 and A. 4911, is amended by
5 adding a new subdivision 4 to read as follows:
6 4. Such program shall be funded by appropriations made available in
7 chapter fifty-three of the laws of two thousand twenty-three to the New
8 York state college of agriculture and life sciences at Cornell universi-
9 ty for the purpose of studying the ecological impacts of agrivoltaics,
10 and any future appropriation made thereafter for the same purpose.
11 § 2. Section 2 of a chapter of the laws of 2023 amending the agricul-
12 ture and markets law relating to establishing the agrivoltaics research
13 program, as proposed in legislative bills numbers S. 7081 and A. 4911,
14 is amended to read as follows:
15 § 2. This act shall take effect immediately and shall expire and be
16 deemed repealed on December 31, 2030.
17 § 3. This act shall take effect immediately, provided, however,
18 section one of this act shall take effect on the same date and in the
19 same manner as a chapter of the laws of 2023 amending the agriculture
20 and markets law relating to establishing the agrivoltaics research
21 program, as proposed in legislative bills numbers S. 7081 and A. 4911,
22 takes effect.
