NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A9568

SPONSOR: Williams
TITLE OF BILL: An act to amend the mental hygiene law, in relation to approved courses of study or equivalent on-the-job experience for counselors   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to require counselors and health profes- sionals to complete courses of study or on-the-job experience related to trauma informed, patient-centered care, treating co-occurring disorders, and sensitivity training.   SUMMARY OF SPECIFIC PROVISIONS: Paragraph 1 of subdivision (d) of section 19.07 of the mental hygiene law, as amended by section 5 of part I of chapter 58 the laws of 2005 is being amended by adding "Such approved courses of study or equivalent on-the-job experience shall include: providing trauma informed, patient-centered care, treating co-occurring disorders, and sensitivity training. Such courses shall be updated as needed to reflect evolving best practices in harm reduction, treatment and long-term recovery. For the purposes of this paragraph, sensitivity training shall mean a form of training with the goal of making people more aware of their own prej- udices and more sensitive to others."   JUSTIFICATION: This bill is designed to establish that counselors and health profes- sionals receive sensitivity training so they can be more understanding and sensitive towards patients. As a result of their training, they will be taught how to provide adequate care for individuals and their fami- lies who are suffering from alcohol and/or substance abuse and/or chemi- cal dependence and/or compulsive gambling. In addition to sensitivity training, counselors must also learn about providing trauma-informed patient-centered care as they patients they see have very unique experiences. In addition, co-occurring disorders often appear in patients these counselors see, so ensuring that they are aware of the disorders will help them provide better care to their patients.   PRIOR LEGISLATIVE HISTORY: 2017/2018: REFERRED TO ALCOHOLISM AND DRUG ABUSE   FISCAL IMPLICATIONS TO STATE AND LOCAL GOVERNMENT: None.   EFFECTIVE DATE: 120th day after it shall become a law.
