to age requirements for gun shows
PURPOSE:
The purpose of this legislation is to protect minors under the age of
fourteen from exposure to deadly weaponry at gun shows.
SUMMARY OF PROVISIONS:
Section one amends subdivision 1 of section 896 of the general business
law, as added by chapter 189 of the laws of 2000, by adding a new para-
graph (d).
Section two sets forth the effective date.
JUSTIFICATION:
As the gun industry prepares a public campaign to broaden the appeal of
guns, it is important that we establish reasonable age limits for admis-
sion to gun shows by children. Within New York State and other areas of
jurisdiction, we have myriad regulations that seek to protect minors
from exposure to certain potentially dangerous situations and influ-
ences. For example, a minor is restricted from watching films or playing
certain video games that portray deadly weaponry and gunplay. Currently,
however, minors of any age may gain unfettered access to a gun show.
As our State continues to look for solutions to violence involving guns,
we must begin by limiting the exposure of young children to these weap-
ons and their capabilities.

AN ACT to amend the general business law, in relation to age require-
ments for gun shows
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs (b) and (c) of subdivision 1 of section 896 of
2 the general business law, as added by chapter 189 of the laws of 2000,
3 are amended and a new paragraph (d) is added to read as follows:
4 (b) notify all firearm exhibitors in writing that a national instant
5 criminal background check must be completed prior to all firearm sales
6 or transfers, including sales or transfers of rifles or shotguns; [and]
7 (c) provide access at the gun show to a firearm dealer licensed under
8 federal law who is authorized to perform a national instant criminal
9 background check where the seller or transferor of a firearm, rifle or
10 shotgun is not authorized to conduct such a check by (i) requiring
11 firearm exhibitors who are firearm dealers licensed under federal law
12 and who are authorized to conduct a national instant criminal background
13 check to provide such a check at cost or (ii) designating a specific
14 location at the gun show where a firearm dealer licensed under federal
15 law who is authorized to conduct a national instant criminal background
16 check will be present to perform such a check at cost. Any firearm deal-
17 er licensed under federal law who performs a national instant criminal
18 background check pursuant to this paragraph shall provide the seller or
19 transferor of the firearm, rifle or shotgun with a copy of the United
20 States Department of Treasury, Bureau of Alcohol, Tobacco and Firearms
21 Form ATF F 4473 and such dealer shall maintain such form and make such
22 form available for inspection by law enforcement agencies for a period
23 of ten years thereafter[.]; and
24 (d) prohibit entrance to the gun show of any person who is under the
25 age of twelve years of age.
26 § 2. This act shall take effect immediately.
