        AN ACT to amend the criminal procedure  law,  in  relation  to  training
          requirements for certain peace officers
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 2.30  of  the  criminal  procedure
     2  law,  as  amended by chapter 491 of the laws of 2010, is amended to read
     3  as follows:
     4    1. Every peace officer in the state  of  New  York  must  successfully
     5  complete  a  training program, a portion of which shall be prescribed by
     6  the municipal police training council and a portion of  which  shall  be
     7  prescribed  by  [his  or  her]  such  officer's  employer.  The  portion
     8  prescribed by the municipal police training council shall  be  comprised
     9  of  subjects, and the hours each is to be taught, that shall be required
    10  of all types or classes of peace  officers.  The  hours  of  instruction
    11  required  by  the municipal police training council shall not exceed one
    12  hundred eighty, unless a greater amount is either  required  by  law  or
    13  regulation,  or  is  requested  by the employer. Provided, however, that
    14  correction officers designated as peace officers under subdivision twen-
    15  ty-five of section 2.10 of this article who are employed as peace  offi-
    16  cers  by another state or local agency shall not be required to complete
    17  duplicate training or instruction in subjects which they  have  success-
    18  fully completed for employment as a correction officer.
    19    The  segment  prescribed  by  the  employer for its employees shall be
    20  comprised of subjects, and the hours each is to be taught,  relating  to
    21  the  special  nature  of the duties of the peace officers employed by it
    22  provided, however, that when the subjects prescribed by the employer are
    23  identical to the subjects in the training program required by the munic-
    24  ipal police training council, the employer  shall  not  be  required  to
    25  provide duplicate training for those subjects.
    26    § 2. This act shall take effect immediately.
