TITLE OF BILL:
An act to amend the education law, in relation to tuition assistance
program awards
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to increase the income threshold cap for
determining eligibility for tuition assistance program awards (TAP) from
$80,000 to $125,000.
 
SUMMARY OF PROVISIONS:
Section 1 amends section 667 subdivision 3 paragraph a, subparagraph
(ii) and (vi) of the education law as amended by section 1 of part B of
Chapter 60 of the laws of 2000.
Section 2 sets the effective date.
 
JUSTIFICATION:
The household income cap has not increased since 2000 when it went from
$50,000 to $80,000. However, the cost of attending a college or univer-
sity has increased tremendously, making it difficult for many students
to gain access to higher education, especially those families with more
than one child. Increasing the cap to $125,000 better aligns with
current tuition prices and inflation rates and will encourage more New
Yorkers to attend college.

AN ACT to amend the education law, in relation to tuition assistance
program awards
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraphs (ii) and (vi) of paragraph a of subdivision 3
2 of section 667 of the education law, as amended by section 1 of part B
3 of chapter 60 of the laws of 2000, are amended to read as follows:
4 (ii) Except for students as noted in subparagraph (iii) of this para-
5 graph, the base amount as determined from subparagraph (i) of this para-
6 graph, shall be reduced in relation to income as follows:

9 (A) Less than seven thousand None

11 (B) Seven thousand dollars or Seven per centum of excess

1 (vi) For the two thousand two--two thousand three academic year and
2 thereafter, the award shall be the net amount of the base amount deter-
3 mined pursuant to subparagraph (i) of this paragraph reduced pursuant to
4 subparagraph (ii) or (iii) of this paragraph but the award shall not be
5 reduced below [five hundred] one thousand dollars.
6 § 2. This act shall take effect immediately.
