        AN  ACT  to amend the public service law, in relation to electric trans-
          mission lines and existing or proposed generating resources

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (e) of subdivision 1 and subdivision 2 of section
     2  126 of the public service law, paragraph (e) of subdivision 1 as amended
     3  by  chapter  521  of the laws of 2015, subdivision 2 as added by chapter
     4  520 of the laws of 1984, are amended to read as follows:
     5    (e) in the case of an electric transmission line, (1)  what  part,  if
     6  any,  of  the  line shall be located underground; (2) that such facility
     7  conforms to  a  long-range  plan  for  the  expansion,  maintenance  and
     8  improvement  of  the electric power grid of the electric systems serving
     9  [this] New York state and interconnected  utility  systems,  which  will
    10  serve the interests of electric system economy and reliability; (3) that
    11  such  facility  will  accommodate  the  interconnection  of  existing or
    12  proposed generating resources or in the  case  of  a  facility  that  as
    13  proposed, has a design capacity of less than one hundred kilovolts, that
    14  no accommodation is necessary because such accommodation would not be in
    15  the interests of electric system economy and reliability; and (4) in the
    16  case  of a facility, that as proposed, would transmit electricity gener-
    17  ated from resources located outside of the boundaries of New York state,
    18  that such electricity would be produced in a manner that  is  consistent
    19  with  the  power  plant  emissions and performance standards established
    20  pursuant to section 19-0312 of the environmental conservation law;
    21    2. In the case of an electric transmission line to be  constructed  by
    22  the  power  authority of the state of New York and located in part under
    23  the waters of Long Island Sound and for the remaining part  underground,
    24  the  commission shall make only the findings and determinations required

     1  by paragraphs (b), (c), (d) and (f) of subdivision one of  this  section
     2  and,  on  the  basis  of  such findings and determinations, shall grant,
     3  grant in part, or deny the certificate.
     4    § 2. This act shall take effect immediately.
