        AN  ACT  to  amend  the  penal  law, in relation to including within the
          offense of promoting prostitution in the first degree,  the  prostitu-
          tion  of a child by a parent, guardian or person charged with the care
          and custody of the child
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 230.32 of the penal law, as added by chapter 627 of
     2  the  laws  of  1978,  the  opening paragraph and subdivisions 1 and 2 as
     3  amended by chapter 368 of the laws  of  2015,  is  amended  to  read  as
     4  follows:
     5  § 230.32 Promoting prostitution in the first degree.
     6    A  person is guilty of promoting prostitution in the first degree when
     7  he or she:
     8    1. knowingly advances or profits from prostitution of  a  person  less
     9  than thirteen years old; or
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    2. being twenty-one years old or more, he or she knowingly advances or
     2  profits from prostitution of a person less than fifteen years old[.]; or
     3    3. being the parent, guardian or other person legally charged with the
     4  care  and  custody  of  a child less than seventeen years old, he or she
     5  knowingly advances or profits from prostitution of such child.
     6    Promoting prostitution in the first degree is a class B felony.
     7    § 2. This act shall take effect on the first of November next succeed-
     8  ing the date on which it shall have become a law.
