Provides for medical assistance payments in the form of certain durable medical equipment for medicare beneficiaries also receiving payments under title XVIII of the federal social security act to not be less than and be based on the approval procedures and payment levels so authorized for eligible individuals who are not eligible pursuant to such title XVIII, less any payments received under such title.

AN ACT to amend the social services law, in relation to level of medical
assistance for durable medical equipment for medicare beneficiaries
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 367-a of the social services law
2 is amended by adding a new paragraph (i) to read as follows:
3 (i) Amounts payable under this title for medical assistance in the
4 form of durable medical equipment (which shall be limited to: wheeled
5 mobility equipment including, but not limited to, manual wheelchairs,
6 powered mobility and wheelchair accessories including, but not limited
7 to, seating and positioning adaptations; and augmentative communication
8 or speech generating devices and accessories) pursuant to paragraph (g)
9 of subdivision two of section three hundred sixty-five-a of this title,
10 provided to eligible persons who are also beneficiaries under title
11 XVIII of the federal social security act shall not be less than and
12 shall be based on the approval procedures and payment levels so author-
13 ized for eligible individuals who are not eligible pursuant to such
14 title XVIII, less any payments received under such title XVIII.
15 § 2. This act shall take effect immediately.
