        AN  ACT  to  amend  the  public health law, in relation to extending the
          number of days within a twelve month period  a  facility  may  receive
          reimbursement for a reserved bed
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subparagraph (ii) of paragraph (b)  of  subdivision  25  of
     2  section 2808 of the public health law, as amended by section 2 of part E
     3  of chapter 57 of the laws of 2017, is amended to read as follows:
     4    (ii) payment to a facility for reserved bed days provided on behalf of
     5  such person for therapeutic leaves of absence may not exceed ten days in
     6  any  twelve  month period. Provided, however, should such person's indi-
     7  vidual care plan provide for therapeutic leave, payment  to  a  facility
     8  for  reserve  bed  days on behalf of such person for non-hospitalization
     9  leaves may not exceed twenty-five days in any twelve month period.
    10    § 2. This act shall take effect immediately.
