Go to top STATE OF NEW YORK ________________________________________________________________________ 293 2009-2010 Regular Sessions IN ASSEMBLY (Prefiled) January 7, 2009 ___________ Introduced by M. of A. MAGNARELLI -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the New York state canal flood mitigation task force The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 73-0105 of the environmental 2 conservation law, as added by chapter 336 of the laws of 2008, is 3 amended to read as follows: 4 6. To help ensure the task force's receipt of a comprehensive and 5 diverse array of views, a citizen advisory board to the task force shall 6 be established. The advisory board shall consist of up to thirteen 7 members appointed by the governor for two years, [seven members shall be8appointed following the recommendation of the governor;] including two 9 members [shall be appointed following] on the recommendation of the 10 temporary president of the senate; two members [shall be appointed11following] on the recommendation of the speaker of the assembly; one 12 member [shall be appointed following] on the recommendation of the 13 minority leader of the senate; and one member [shall be appointed14following] on the recommendation of the minority leader of the assembly. 15 The advisory board shall represent a diverse array of interests, includ- 16 ing property owners residing adjacent to or in close proximity to the 17 canal system or major water bodies within the Oswego river basin, recre- 18 ational and commercial users of the canal system, environmental groups 19 and hydroelectric power generators that operate facilities within the 20 canal system. No member of the advisory board may be concurrently 21 employed by, or provide goods or services to, any agency or public 22 corporation which is represented on the task force. The commissioner 23 shall select a member of the advisory board to serve as chairperson. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect immediately and shall be deemed to 2 have been in full force and effect on and after July 21, 2008; provided, 3 however, the amendments to subdivision 6 of section 73-0105 of the envi- 4 ronmental conservation law made by section one of this act shall not 5 affect the repeal of such section and shall be deemed repealed there- 6 with.
