        AN ACT to amend the executive law, in relation  to  the  appointment  of
          interpreters to be used in parole board proceedings
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 8 of section 259-i of  the  executive  law,  as
     2  added  by  a  chapter  of  the  laws of 2016, amending the executive law
     3  relating to translation services for inmates appearing before the parole
     4  board, as proposed in legislative bills numbers S. 992 and A.  5548,  is
     5  amended to read as follows:
     6    8. Foreign born or non-English speaking person before the board.  Upon
     7  notification  from the department pursuant to section two hundred fifty-
     8  nine-e of this article, or upon the request of any foreign born or  non-
     9  English speaking person who is scheduled to participate in an interview,
    10  parole release hearing, preliminary hearing or revocation hearing, there
    11  shall  be  appointed  from the New York state office of general services
    12  statewide administrative services contract, a qualified interpreter [who
    13  is certified by a recognized national or New  York  state  credentialing
    14  authority]  to interpret the proceedings to and the statements or testi-
    15  mony of such person. The board shall determine a reasonable fee for  all
    16  such interpreting services, the cost of which shall be a charge upon the
    17  board  of  parole. No such request or appointment shall cause a delay of
    18  release from incarceration of such person.
    19    § 2. This act shall take effect on the  same  date  and  in  the  same
    20  manner  as  a  chapter  of  the laws of 2016, amending the executive law
    21  relating to translation services for inmates appearing before the parole
    22  board, as proposed in legislative bills numbers  S.  992  and  A.  5548,
    23  takes effect.
