AN ACT to amend the insurance law, in relation to prescription coverage
for shingles
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (i) of section 3216 of the insurance law is
2 amended by adding a new paragraph 35 to read as follows:
3 (35) Every policy which provides coverage for prescription drugs shall
4 include coverage for the cost of drugs and vaccines for the treatment
5 and prevention of shingles approved by the federal food and drug admin-
6 istration, including the vaccine zostavax, or other vaccines to prevent
7 shingles approved as substitutes by such food and drug administration
8 under the prescription of a health care provider legally authorized to
9 prescribe under title eight of the education law.
10 § 2. Subsection (l) of section 3221 of the insurance law is amended by
11 adding a new paragraph 21 to read as follows:
12 (21) Every policy which provides coverage for prescription drugs shall
13 include coverage for the cost of drugs and vaccines for the treatment
14 and prevention of shingles approved by the federal food and drug admin-
15 istration, including the vaccine zostavax, or other vaccines to prevent
16 shingles approved as substitutes by such food and drug administration
17 under the prescription of a health care provider legally authorized to
18 prescribe under title eight of the education law.
19 § 3. Section 4303 of the insurance law is amended by adding a new
20 subsection (ss) to read as follows:
21 (ss) Every contract issued by a hospital services corporation or a
22 health services corporation which provides coverage for prescription
23 drugs shall include coverage for the cost of drugs and vaccines for the

1 treatment and prevention of shingles approved by the federal food and
2 drug administration, including the vaccine zostavax, or other vaccines
3 to prevent shingles approved as substitutes by such food and drug
4 administration under the prescription of a health care provider legally
5 authorized to prescribe under title eight of the education law.
6 § 4. This act shall take effect on the sixtieth day after it shall
7 have become a law.
