AN ACT to amend the general business law, in relation to prohibiting the
sale of certain balloons
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 399-k to read as follows:
3 § 399-k. Prohibit the sale of certain balloons. 1. It shall be unlaw-
4 ful for any person, firm, partnership or corporation to knowingly
5 import, sell, offer for sale, manufacture, distribute, transport or
6 otherwise market any balloon or other inflatable object made of a
7 conductive material, including but not limited to mylar, filled with a
8 gas which is lighter than air without:
9 (a) a weight affixed to such object which prevents the object from
10 being lighter than air;
11 (b) a warning statement attached to such object; or
12 (c) identification information of the manufacturer printed on the
13 object.
14 2. It shall be unlawful for any person, firm, partnership or corpo-
15 ration to knowingly import, sell, offer for sale, manufacture, distrib-
16 ute, transport or otherwise market any balloon or other inflatable
17 object which has attached an electrically conductive string, tether,
18 streamer, or other electrically conductive appurtenance.
19 § 2. This act shall take effect on the ninetieth day after it shall
20 have become a law.
