TITLE OF BILL: An act to amend the education law, in relation to
establishing a task force to evaluate the implementation of the common
core state standards
 
PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is
to establish a common core state standards evaluation task force with
the purpose of studying the implementation of the common core state
standards.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section one amends the education law by adding a new section 115.
Section two sets forth the effective date.
 
JUSTIFICATION: On January 10th, 2011, the Board of Regents approved
the Common Core Learning Standards for English Language Arts & Literacy
and Common Core Learning Standards for Mathematics, plus a new set of
Pre-kindergarten Standards.
This bill establishes the common core Standards Evaluation Task Force to
evaluate the implementation of the Common core learning standards. The
task force's evaluation of the common core state standards would
include: 1)-a description of actions taken by the State to date to
implement the new standards and a timeline for additional actions to be
taken; 2) a comparison of the common core state standards to the academ-
ic standards that they replaced; 3) an estimate of the full cost for
school districts to implement the common core state standards, including
those already incurred and those to be incurred in the future; and 4) an
analysis of student performance on the State assessments before and
after the adoption of the common core state standards. The task force is
also directed to study and evaluate the issue of student and fami-
ly,personal data mining and a student's right to privacy.
The task force is to issue its final report no later than six months
after it is established. Prior to issuing its final report, the task
force is to conduct at least four public hearings to gather, informa-
tion.

AN ACT to amend the education law, in relation to establishing a task
force to evaluate the implementation of the common core state stand-
ards
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 115 to
2 read as follows:
3 § 115. Common core state standards evaluation task force. 1. a. There
4 is established the common core state standards evaluation task force.
5 The purpose of the task force shall be to study the implementation of
6 the common core state standards developed by the common core state stan-
7 dards initiative.
8 b. The task force shall consist of the following nineteen members:
9 (1) the commissioner, or the commissioner's designee, who shall serve
10 ex officio;
11 (2) eight members appointed by the governor, one upon the recommenda-
12 tion of the United Federation of teachers, one upon the recommendation
13 of the school administrators association of New York state, one upon the
14 recommendation of the New York state teachers association, one upon the
15 recommendation of the association for supervision and curriculum, one
16 upon the recommendation of the New York state school boards association,
17 one representative of a nonpublic school located in New York state, and
18 two public members who are the parents or guardians of a student
19 enrolled in a New York state public school;
20 (3) two members of the senate, who shall not be from the same poli-
21 tical party, appointed by the temporary president;
22 (4) two members of the assembly, who shall not be from the same poli-
23 tical party, appointed by the speaker of the assembly;

1 (5) one member, appointed by the temporary president of the senate,
2 who has demonstrated expertise in language arts literacy instruction and
3 curriculum;
4 (6) one member, appointed by the speaker of the assembly, who has
5 demonstrated expertise in language arts literacy instruction and curric-
6 ulum;
7 (7) one member, appointed by the temporary president of the senate,
8 who has demonstrated expertise in mathematics instruction and curric-
9 ulum;
10 (8) one member, appointed by the speaker of the assembly, who has
11 demonstrated expertise in mathematics instruction and curriculum;
12 (9) one member, appointed by the temporary president of the senate,
13 who is the parent or guardian of a student enrolled in a New York state
14 public school; and
15 (10) one member, appointed by the speaker of the assembly, who is the
16 parent or guardian of a student enrolled in a New York state public
17 school.
18 c. Appointments to the task force shall be made within thirty days of
19 the date this section take effect. Vacancies in the membership of the
20 task force shall be filled in the same manner as the original appoint-
21 ments were made. Members of the task force shall serve without compen-
22 sation, but shall be reimbursed for necessary expenditures incurred in
23 the performance of their duties as members of the task force within the
24 limits of funds appropriated or otherwise made available to the task
25 force for its purposes.
26 2. The task force shall organize as soon as practicable following the
27 appointment of its members, but no later than sixty days after the
28 appointment of the members. The task force shall choose one member of
29 the senate and one member of the assembly to serve as co-chairpersons.
30 The task force shall also appoint a secretary who need not be a member
31 of the task force.
32 3. The department shall provide such stenographical, clerical, and
33 other assistance, and such professional staff as the task force requires
34 to carry out its work. The task force shall also be entitled to call to
35 its assistance and avail itself of the services of the employees of any
36 state, county, or municipal department, board, bureau, commission, or
37 agency as it may require and as may be available for its purposes.
38 4. a. The task force shall evaluate the implementation of the common
39 core state standards. The evaluation shall include, but need not be
40 limited to, the following:
41 (1) a description of actions taken by the state to date to implement
42 the common core state standards and a timeline of any subsequent actions
43 to be taken;
44 (2) a comparison of the common core state standards for English
45 language arts and mathematics to the core curriculum content standards
46 in language arts literacy and mathematics that existed prior to the
47 adoption of the common core state standards;
48 (3) an estimate of the full cost for school districts to implement the
49 common core state standards, including those costs already incurred by
50 districts and those to be incurred in the future; and
51 (4) an analysis of students' performance on the state assessments
52 prior to the two thousand fourteen--two thousand fifteen school year and
53 in the two thousand fourteen--two thousand fifteen and subsequent school
54 years. The analysis shall assess changes in the achievement gap between
55 different racial and ethnic groups and different economic groups.

1 b. The task force shall also study and evaluate the issue of student
2 and family personal data mining and a student's right to privacy. The
3 task force shall consider, but not be limited to, data related to learn-
4 ing disabilities, student behavior, political affiliation, religious
5 affiliation, and medical history.
6 5. The task force shall issue a final report to the governor and to
7 the legislature no later than six months after the task force organizes.
8 Prior to issuing its final report, the task force shall hold at least
9 four public hearings, with at least one public hearing to occur in each
10 of the northern, central, and southern regions of the state, to gather
11 information regarding the implementation of the common core state stand-
12 ards, the mining of student and family data, and student privacy rights.
13 6. The department shall not administer any assessment prior to the
14 issuance of the final report by the task force pursuant to subdivision
15 five of this section.
16 § 2. This act shall take effect immediately.
