        AN ACT to amend the vehicle and traffic law, in  relation  to  emergency
          ambulance service vehicles
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.  Section 115-c of the vehicle and traffic law, as added  by
     2  chapter 142 of the laws of 1981, is amended to read as follows:
     3    § 115-c. Emergency  ambulance  service vehicle. An emergency ambulance
     4  service vehicle shall be defined as [an appropriately equipped] a  motor
     5  vehicle  owned or operated by an ambulance service as defined in section
     6  three thousand one of the public health law [and] that is:
     7    1. used and appropriately equipped for  the  purpose  of  transporting

     8  emergency medical personnel and equipment to sick or injured persons[.];
     9  or
    10    2.  used by or under the direction of an ambulance service operator or
    11  ambulance service supervisory or other personnel designated  in  writing
    12  by the operator of the ambulance service as emergency response personnel
    13  for the purpose of providing command, supervision or operational support
    14  therefor. Such written designation shall be subject to revocation at any
    15  time  by  the  operator  who  certified  such  designation or his or her
    16  successor in office. For the purposes of this subdivision, an  emergency
    17  ambulance  service  vehicle shall have the name of the ambulance service
    18  conspicuously displayed on the vehicle and shall be considered an  emer-

    19  gency  ambulance  service  vehicle  only  when operated by the ambulance
    20  service operator, or his or her designee as certified in writing, in his
    21  or her official capacity.   A  vehicle  deemed  an  emergency  ambulance

     1  service  vehicle under this subdivision shall not be used for the trans-
     2  port of sick or injured persons and shall not be subject  to  regulation
     3  by the department of health.
     4    § 2. This act shall take effect immediately.
