AN ACT to amend the penal law, in relation to trespass
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 140.05 of the penal law, as amended by chapter 307
2 of the laws of 1971, is amended to read as follows:
3 § 140.05. Trespass.
4 A person is guilty of trespass when he knowingly:
5 a. enters or remains unlawfully in or upon premises; or
6 b. permits the protrusion of:
7 i. personal property;
8 ii. a tree, bush, shrub or other plantlife; or
9 iii. water from a hose, sprinkler or other device in or upon the prem-
10 ises of another.
11 Trespass is a violation.
12 § 2. This act shall take effect on the first of November next succeed-
13 ing the date on which it shall have become a law.
