Establishes the canal pilot water level management program and hydraulic model for the purpose of enhancing navigation and flood mitigation, improving real-time flood forecasting, enabling pro-active flood responsiveness and developing unified operating procedures through collection, analysis, coordination and dissemination of real-time water and systems data along the canal system; provides for a report to be issued within three years of the effective date.

AN ACT to amend the canal law, in relation to establishing the pilot
water level management program and hydraulic model
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The canal law is amended by adding a new section 135 to
2 read as follows:
3 § 135. Pilot water level management program. 1. Pilot program. The
4 corporation shall establish and operate the pilot water level management
5 program for the purpose of enhancing navigation and flood mitigation,
6 improving real-time flood forecasting, enabling pro-active flood respon-
7 siveness and developing unified operating procedures through the
8 collection, analysis, coordination and dissemination of real-time water
9 and systems data in and along the canal system. Such program shall be
10 designed for and implemented in the Mohawk River basin canal system and
11 include locks seven through twenty-two. The pilot water level management
12 program shall include, but not be limited to:
13 (a) the evaluation of existing water management infrastructure includ-
14 ing gauges at locks, in and along the canal system, feeder tributaries
15 and affecting reservoirs;
16 (b) the implementation of real-time and remote sensing technology, and
17 other advanced water measurement devices as deemed appropriate;
18 (c) a centralized real-time data collection and command center with an
19 interconnected data collection and information sharing system to include
20 locks and other appropriate canal system water management facilities;
21 (d) development of unified operating and command procedures in
22 conjunction with the water level management program and its systems;

1 (e) information sharing and coordination with appropriate agencies to
2 include, but not be limited to, the National Weather Service, the State
3 Emergency Management Office, New York Power Authority and appropriate
4 county officers from counties adjacent or intersected by the canal
5 system; and
6 (f) an enhanced system for public notification; and
7 (g) the development of a detailed hydraulic model of the canal system
8 and water level control structures.
9 2. Report. (a) Not later than three years after the effective date of
10 this section, the corporation shall prepare a report evaluating the
11 effectiveness of the pilot program. Such report shall include, but need
12 not be limited to:
13 (i) A detailed description of the program as it is implemented to
14 include each of the items set out in paragraphs (a) through (g) of
15 subdivision one of this section;
16 (ii) An assessment and recommendation for improving the water level
17 management program and costs thereof;
18 (iii) An assessment of the efficacy of the water level management
19 program, and the degree to which it successfully addressed navigation
20 and flood mitigation enhancement, real-time flood forecasting, pro-ac-
21 tive flood responsiveness and development of unified operating proce-
22 dures, as well as other realized benefits; and
23 (iv) Recommendation as to the expansion of the program to other parts
24 of the canal and costs thereof.
25 (b) The corporation shall submit such report to the governor, commis-
26 sioner of transportation, temporary president of the senate, speaker of
27 the assembly and the senate and assembly transportation committees.
28 § 2. This act shall take effect immediately.
