        AN ACT to amend the administrative code of the  city  of  New  York,  in
          relation  to  exempting wheelchair accessible taxicabs, livery service

          and black car service vehicles from certain fees
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  19-504 of the administrative code of the city of
     2  New York is amended by adding a new subdivision r to read as follows:
     3    r. Notwithstanding any other provisions of law, all licensed operators
     4  of wheelchair accessible vans who are: (i) not owners  of  a  wheelchair
     5  accessible  medallion  issued  by  the  New York City Taxi and Limousine
     6  Commission or (ii) owners of a livery  or  black  car  service  but  who
     7  provide  wheelchair  accessible  vans  for hire in the city of New York,
     8  shall be exempt from the fees listed in subdivision b of this section to

     9  the extent that such fees pertain to  the  wheelchair  accessible  vans.
    10  The  term  "wheelchair  accessible  van" shall, for the purposes of this
    11  subdivision, refer to a vehicle that complies with  federal  regulations
    12  promulgated  pursuant  to the Americans with Disabilities Act applicable
    13  to vans under twenty-two feet in length, by the  federal  Department  of
    14  Transportation,  in  Code of Federal Regulations, title 49, parts 37 and
    15  38, and by the federal Architecture and Transportation Barriers  Compli-
    16  ance  Board,  in Code of Federal Regulations, title 36, section 1192.23,
    17  and the Federal Motor Vehicle Safety Standards, Code  of  Federal  Regu-
    18  lations, title 29, part 57.
    19    § 2. Section 11-802 of the administrative code of the city of New York

    20  is amended by adding a new subdivision e to read as follows:
    21    e. Notwithstanding any other provisions of law, all licensed operators
    22  of  wheelchair  accessible  vans who are: (i) not owners of a wheelchair
    23  accessible medallion issued by the New  York  City  Taxi  and  Limousine

     1  Commission  or  (ii)  owners  of  a  livery or black car service but who
     2  provide wheelchair accessible vans for hire in the  city  of  New  York,
     3  shall  be exempt from the fees listed in this section to the extent that

     4  such  fees  pertain  to the wheelchair accessible van.  The term "wheel-
     5  chair accessible van" shall, for the purposes of this subdivision, refer
     6  to a vehicle that complies with federal regulations promulgated pursuant
     7  to the Americans with Disabilities Act applicable to vans under  twenty-
     8  two feet in length, by the federal Department of Transportation, in Code
     9  of  Federal  Regulations,  title 49, parts 37 and 38, and by the federal
    10  Architecture and Transportation Barriers Compliance Board,  in  Code  of
    11  Federal  Regulations,  title  36, section 1192.23, and the Federal Motor
    12  Vehicle Safety Standards, Code of Federal Regulations,  title  29,  part
    13  57.
    14    §  3.  This  act shall take effect on the ninetieth day after it shall

    15  have become a law, provided, however that effective immediately the  New
    16  York  City  Taxi  and Limousine Commission shall promulgate any rules or
    17  regulations necessary for the implementation of this act.
