          tee on Health
 
        AN ACT to amend the public health law, in relation to  accessibility  to
          bone  marrow  registry information; and to amend a chapter of the laws
          of 2020, amending the public health  law  relating  to  requiring  the
          department  of health to develop and disseminate information regarding
          bone marrow  donor  programs  and  authorizing  physicians,  physician
          assistants  and  nurse  practitioners  to  provide such information to
          patients, as proposed in legislative bills  numbers  S.  6705  and  A.
          5370-A, in relation to the effectiveness thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 4369 of the public health law, as added by a  chap-
     2  ter  of  the  laws  of  2020, amending the public health law relating to
     3  requiring the department of health to develop and  disseminate  informa-
     4  tion  regarding  bone  marrow donor programs and authorizing physicians,
     5  physician assistants and nurse practitioners to provide such information
     6  to patients, as proposed in legislative bills numbers  S.  6705  and  A.
     7  5370-A, is amended to read as follows:
     8    §  4369.  Bone  marrow  registry  information. 1. The commissioner, in
     9  consultation with health care practitioners and others with expertise in
    10  bone marrow donation and transplant and with the assistance of the tran-
    11  splant council as appropriate, shall develop and make available informa-
    12  tion regarding bone marrow donation and registries,  including  but  not
    13  limited  to  the  National  Marrow Donor Program "Be The Match Registry"
    14  registry and The Bone Marrow Foundation. Such information shall include,
    15  but not be limited to:
    16    (a) the need for bone marrow donations;
    17    (b) patient populations that would benefit from bone marrow donations;
    18    (c) how to join [the] a bone marrow registry; and
    19    (d) how to acquire a free buccal swab kit from a bone marrow registry.
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    2. The information required by this section shall  be  made  available
     2  [to  the  public  by  the commissioner] on the department's website [and
     3  through other means determined  by  the  commissioner.  The  information
     4  shall  also  be  provided  by  the commissioner to physicians, physician
     5  assistants  and  nurse  practitioners providing primary care for dissem-
     6  ination under subdivision three of this section.
     7    3. Each physician, physician assistant and nurse practitioner  provid-
     8  ing  primary  care may inquire of new patients who are eighteen years of
     9  age or older and under forty-five years of  age  on  their  new  patient
    10  intake form as to whether the patient is registered with the bone marrow
    11  registry.  If  the  patient states that he or she is not registered with
    12  the bone marrow registry, the physician, physician  assistant  or  nurse
    13  practitioner  providing primary care shall provide information developed
    14  and disseminated by the department regarding the bone marrow registry to
    15  the patient] in a printable format to allow the public  to  access  such
    16  information  and for health care practitioners providing primary care to
    17  provide such information to patients who are eighteen years  of  age  or
    18  older  and  under  forty-five years of age who are not registered with a
    19  bone marrow registry.
    20    § 2. Section 2 of a chapter of the laws of 2020, amending  the  public
    21  health law relating to requiring the department of health to develop and
    22  disseminate information regarding bone marrow donor programs and author-
    23  izing  physicians,  physician  assistants  and  nurse  practitioners  to
    24  provide such information to patients, as proposed in  legislative  bills
    25  numbers S. 6705 and A. 5370-A, is amended to read as follows:
    26    § 2. This act shall take effect [on the first of January next succeed-
    27  ing  the  date  upon  which]  one year after it shall have become a law.
    28  Effective immediately [the addition, amendment and/or repeal of any rule
    29  or regulation necessary for the implementation of this act on its effec-
    30  tive date are authorized to be made and completed  on  or  before],  the
    31  commissioner  of  health  may  make  regulations  and take other actions
    32  reasonably necessary to implement this act on such date.
    33    § 3. This act shall take effect immediately; provided,  however,  that
    34  section  one  of  this act shall take effect on the same date and in the
    35  same manner as section 1 of a chapter of the laws of 2020, amending  the
    36  public  health  law  relating  to  requiring the department of health to
    37  develop and disseminate information regarding bone marrow donor programs
    38  and authorizing physicians, physician assistants and nurse practitioners
    39  to provide such information to  patients,  as  proposed  in  legislative
    40  bills numbers S. 6705 and A. 5370-A, takes effect.
