        AN ACT to amend the education law, in relation to private school agent's
          certificate
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  Subdivision  3  of  section 5004 of the education law, as
     2  amended by chapter 381 of the laws  of  2012,  is  amended  to  read  as
     3  follows:
     4    3.  Exempted  from the requirements of this section are persons acting
     5  solely for schools which are not required to be licensed or are  specif-
     6  ically  exempted  from  the  licensing  requirements  of  this  article.
     7  Persons who are paid to procure, solicit or enroll students on the prem-
     8  ises of schools required to be licensed shall not  be  exempt  from  the
     9  provisions  of  this  section.  [The  certification requirements of this
    10  section shall not apply to persons receiving gifts or other non-monetary
    11  considerations valued at not  more  than  seventy-five  dollars  from  a

    12  school from which they have graduated or are currently enrolled for each
    13  student referred for enrollment at the school.]
    14    §  2.  This  act  shall take effect immediately and shall be deemed to
    15  have been in full force and effect on and after December 15, 2012.
