Establishes the Wheatland-Scottsville Joint Fire District; provides for the dissolution of the town of Wheatland fire protection district located in the town of Wheatland, Monroe county, New York, and the establishment of the Wheatland-Scottsville joint fire district by the town board of the Town of Wheatland, and the board of trustees of the village of Scottsville, Monroe county.

AN ACT in relation to the establishment of the Wheatland-Scottsville
joint fire district
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Except as otherwise provided in this act, the dissolution
2 of the town of Wheatland fire protection district located in the town of
3 Wheatland, Monroe county, New York, the establishment of the Wheatland-
4 Scottsville joint fire district by the town board of the town of Wheat-
5 land, and the board of trustees of the village of Scottsville, Monroe
6 county, and all actions taken in anticipation or as a result thereof,
7 shall be governed, except as specifically excluded and excepted herein,
8 by all applicable general, special and local laws, including, but not
9 limited to the laws of the state of New York, including but not limited
10 to the town law, the village law, the general municipal law, and the
11 local finance law.
12 § 2. The payment of principal and interest on any outstanding bonds or
13 notes, leases or other obligations of the village of Scottsville,
14 related to fire protection, issued or assumed by the Wheatland-Scotts-
15 ville joint fire district, shall be a charge on the taxable real proper-
16 ty located in the Wheatland-Scottsville joint fire district.
17 § 3. Any bond resolution adopted by the board of fire commissioners of
18 the Wheatland-Scottsville joint fire district in accordance with the
19 local finance law to authorize the issuance of serial bonds in an amount
20 not to exceed $2,000,000 to finance the acquisition from the village of
21 Scottsville of the village's firehouse, the land on which the firehouse
22 is situated, and the village's firefighting equipment, apparatus and
23 communication equipment shall become effective upon adoption by such
24 board of a resolution and shall not be subject to a mandatory referendum
25 in accordance with section 38.00 of the local finance law. Subsequent to

1 the issuance of such serial bonds for these specific purposes, any
2 future borrowing by the fire district shall be in accordance with the
3 applicable provisions of New York state law.
4 § 4. (a) The village of Scottsville is hereby empowered and directed
5 to transfer to the Wheatland-Scottsville joint fire district, the unex-
6 pended and encumbered balance of the appropriations for the fire
7 protection purposes in the village's 2021-2022 budget, for use by the
8 Wheatland-Scottsville joint fire district for any lawful object or
9 purpose of the district.
10 (b) The town of Wheatland is hereby empowered and directed to transfer
11 to the Wheatland-Scottsville joint fire district, an amount equal to the
12 unexpended and encumbered balance of the appropriations for the fire
13 protection purposes in the town's 2021 budget, which has not been paid
14 to the village for use by the Wheatland-Scottsville joint fire district
15 for any lawful object or purpose of the district.
16 § 5. The Wheatland-Scottsville joint fire district is hereby empowered
17 and may enter into one or more contracts with the Scottsville fire
18 department, Inc. for the provision to all or any portion of the Wheat-
19 land-Scottsville joint fire district for fire protection services, emer-
20 gency services in case of accidents, calamities or other emergencies in
21 connection with which services of firefighters would be required, gener-
22 al ambulance service, or any combination thereof. Except as provided
23 herein, such contracts shall be entered into pursuant to, and governed
24 by, subdivision 22 of section 176 of the town law and, as provided ther-
25 ein, subject to the provisions of section 209-b of the general municipal
26 law.
27 § 6. This act shall take effect immediately.
