          RAMOS, STERN, THIELE, WOERNER, MONTESANO, NORRIS, SCHMITT -- read once
          and referred to the Committee on Housing
 
        AN ACT in relation to defining residential construction as an  essential
          business

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any other provision of law, rule  or  regu-
     2  lation  during  the  period  of the COVID-19 state disaster emergency as
     3  declared pursuant to executive order 202 of 2020, and extensions  there-
     4  of,  and  article  2-B  of  the  executive  law,  essential business, as
     5  provided  for  in  executive  order  202.6,  shall  include  residential
     6  construction  not  in  excess  of three stories, notwithstanding whether
     7  such construction is defined as affordable.
     8    § 2. This act shall take effect immediately.
